Boating Under the Influence (BUI)
Miami BUI Lawyers
According to the Florida Fish and Wildlife Conservation Commission (FWC), Division of Law Enforcement, Florida had the highest number of boating accidents in the nation in 2010, topping out at 668, and thereby ranking number one. In 2010, the sunshine state (Florida) ranked number one with the most registered recreational vessels in the nation with 914,535 in total. (Florida Fish and Wildlife Conservation Commission)
With Florida ranking number one with the most registered recreational vessels in the nation, it makes perfect sense why Florida would lead the nation in the number of boating accidents and why a significant number of boaters would be arrested for boating under the influence of alcohol or drugs as compared to other states.
In Florida, boating under the influence (BUI) is covered under Section 327.35 of the Florida Statutes. Under § 327.35, a person is guilty of BUI when he or she operates a vessel within the state and is under the influence of alcoholic beverages, or any chemical substance set forth in §877.111, or any controlled substance covered under chapter 893, when affected to the extent that their normal faculties are impaired, or when their blood alcohol content is .08% or greater.
The penalties for boating under the influence on a first conviction include fines ranging between $500 and $1,000 and up to 6 months in jail.
For a second BUI conviction, the penalties include fines ranging between $1,000 and $2,000 and up to 9 months in jail. For a third BUI conviction within 10 years of a prior conviction, the individual is guilty of committing a third degree felony and shall be punished to fines ranging between $2,000 and $5,000, and a maximum term of imprisonment of 12 months.
