What to Expect at the Administrative License Hearing

DMV hearings are different than court hearings. They take place at your local DMV and are presided over by an administrative judge who does not have a law degree. If you can convince the administrative judge that your charges were not deserved, your license may not be suspended.

At this hearing, you will present your argument before the administrative judge and prove to him or her that you:

  • Were unlawfully stopped or arrested;
  • That you were not informed of the consequences of refusing a blood test;
  • That you were never asked to submit to a blood test; or
  • That your test results were less than 0.08%.
