Facing Federal Conspiracy Charges? Call Our Team!

In the realm of federal crimes, conspiracy can span many different types of offenses. Federal prosecutors may lean upon conspiracy charges to enhance penalties or prosecute a defendant based on a broader scope of evidence. If a federal prosecutor can prove, beyond a doubt, that the defendant was one of two or more people who conspired to commit a federal crime, this may be enough to secure a federal conspiracy conviction.

Federal conspiracy charges typically involve the following key factors:

  • Two or more people agreed to commit a federal crime.
  • Some step/act was taken toward committing that crime.

Even if the intended or agreed-upon offense was not actually carried out, federal conspiracy charges may still apply.

The nuances of federal conspiracy charges can make them difficult to defend, but our Miami conspiracy defense lawyers have extensive experience fighting for our clients’ rights – against all odds.

18 U.S. Code § 371: Conspiracy to Commit Offense or to Defraud United States

According to U.S. Code § 371, conspiring to commit any offense against the U.S. or to defraud the U.S. and acting toward the commission of the offense is punishable by a fine and/or imprisonment for up to five years. If the intended offense is a misdemeanor, however, the punishment cannot exceed the maximum penalty for that misdemeanor offense.

Penalties for Conspiracy Under Federal Law

What if a person is charged with mortgage fraud, for example, and is also accused of conspiring with another person to commit that crime? These are two separate charges and penalties for both may apply. In this example, the defendant may face the maximum penalties for mortgage fraud, plus an additional five years for conspiracy.
